1. General Information
1.1. Orders placed through www.enigmafurniture.com shall be deemed finalized only after the Buyer approves the pre-information form electronically and completes the payment obligation in full. In cases of partial payment or lack of payment confirmation, the order shall not be considered valid and no delivery obligation shall arise.
1.2. Orders are shipped within a maximum of 20 business days following payment confirmation. Weekends and public holidays are excluded. The legal maximum delivery period is 30 days.
For custom-made products, the delivery period is determined by the Seller.
The Seller bears responsibility for any loss or damage until the product is delivered to the Buyer.
2. Delivery Time and Delays
2.1. The delivery period starts once the order is confirmed and payment is received.
Estimated delivery times:
- Within the same city: 1–3 business days
- Between cities: 2–7 business days
2.2. The Seller cannot refuse delivery due to supplier issues or pricing errors. If the product becomes unavailable, the Buyer shall be informed immediately, and the order may be canceled with a full refund upon request.
2.3. If delivery exceeds the agreed period, the Buyer reserves the right to terminate the contract and request a refund via written notice.
3. Delivery Method and Inspection Obligation
3.1. Orders are delivered via the Seller’s contracted shipping company to the address specified by the Buyer. Delivery is documented via shipping note or delivery report.
3.2. The Buyer must inspect the package in the presence of the courier upon delivery.
If damage or defects are detected, a Damage Report must be issued, and the product must not be accepted.
Products accepted without such documentation are deemed to be received in good condition, and subsequent claims (except hidden defects) shall be invalid.
3.3. If no objection is made to the invoice within 8 days, it shall be deemed accepted. Visible defects must be reported immediately, while other defects must be reported within 10 days.
4. Delivery Fees
4.1. Shipping is free for orders of 100,000 TRY and above.
For lower amounts, shipping costs are borne by the Buyer and added at checkout.
4.2. Delivery fees may vary during promotional periods. Campaign-specific conditions shall apply.
5. Change of Delivery Address
5.1. The Buyer may request an address change before shipment by contacting customer service and obtaining written approval.
5.2. Once the product has been shipped, address change requests may not be accepted or any additional costs shall be borne by the Buyer.
6. Undelivered Orders and Buyer Default
6.1. If the Buyer is not available at the delivery address, the shipment will be redirected to the nearest branch and the Buyer will be informed.
6.2. The Buyer must collect the order within 15 days.
Uncollected shipments will be returned to the Seller.
If the Buyer unjustifiably refuses delivery, round-trip shipping costs may be charged or deducted from any refund.
7. Cancellation, Return, and Withdrawal
7.1. Consumers may exercise their right of withdrawal from order confirmation until delivery and within the legal period after delivery.
7.2. If withdrawal is exercised, all payments shall be refunded within 10 days of notification.
The Buyer must return the product within 20 days.
The Seller cannot refuse returns made via the contracted shipping service.
8. International Delivery
8.1. International shipments are subject to the customs regulations of the destination country.
8.2. All customs duties, taxes, storage fees, and import procedures (unless otherwise stated under Incoterms) are the sole responsibility of the Buyer.
The Seller is not obliged to refund products not cleared from customs.
9. Force Majeure
9.1. The Seller shall not be held liable for delays caused by force majeure events such as natural disasters, war, pandemics, government actions, or strikes.
9.2. Known conditions at the time of contract or seasonal workload (e.g., holidays, campaigns) shall not be considered force majeure.
9.3. If force majeure exceeds 30 days and delivery becomes impossible, the Seller shall notify the Buyer and refund the payment within 14 days.
This document is provided for informational purposes. In case of discrepancy, the Turkish version shall prevail.
10. International Delivery Terms
10.1. Delivery times for international orders may differ from domestic deliveries. Delivery duration depends on production processes, international logistics operations, customs clearance, and local distribution procedures in the destination country.
10.2. Delivery times stated for international shipments are estimates only and do not constitute a binding commitment. Delays shall not be considered a breach of contract.
10.3. The SELLER shall be deemed to have fulfilled its obligation once the product is handed over to the international shipping carrier. The SELLER shall not be held responsible for delays arising after this stage, including customs procedures, international transportation, and local distribution processes.
10.4. All customs duties, import taxes, storage fees, and similar charges shall be borne solely by the BUYER.
10.5. If the BUYER fails to complete customs procedures, refuses to pay applicable taxes, or declines to accept delivery, all return-related costs shall be borne by the BUYER, and the SELLER may not be obligated to issue a refund.
10.6. Delays caused by customs procedures, international logistics, transportation issues, or actions of public authorities shall be considered force majeure.
10.7. For international returns, shipping costs shall be borne by the BUYER. Customs duties and import-related expenses are non-refundable.
In case of conflict between domestic and international delivery terms, the provisions of this clause shall prevail for international orders.
